France to create blacklist of school staff with inappropriate behavior toward minors

Education Minister Edouard Geffray announced on Wednesday, May 27, that staff who have been removed from schools for inappropriate behavior with minors will be placed on a blacklist preventing any re-employment in education, even without a criminal conviction. The measure is part of a broader child protection bill presented by Health Minister Stéphanie Rist and Justice Minister Gérald Darmanin. The bill also introduces continuous background checks for all personnel working with children.

"Ça veut dire que [quand] nous aurons évincé un agent public, un surveillant, etc. en raison de son comportement avec les mineurs, quand bien même il n'aurait pas été condamné, il sera inscrit sur une liste qui empêchera toute forme de réemploi au sein de l'école," Geffray said after the Council of Ministers. "Il ne pourra pas se présenter dans un autre établissement. Il ne pourra pas repasser un concours pour devenir professeur," he added.

The measure is part of a broader child protection bill carried by Health Minister Stéphanie Rist and Justice Minister Gérald Darmanin. The bill introduces "contrôles systématiques des antécédents pour tous ceux qui encadrent des enfants."

Under the education component, background checks currently performed only at recruitment via criminal records and sex offender files will become continuous. "Un système périodique permettra, en temps réel, de vérifier la situation de ceux qui sont déjà recrutés," Geffray said.

The government also plans to introduce systematic checks for all occasional staff using attestations of honorability. Education and Youth/Sports databases will be merged "pour éviter qu'une personne qui aurait été condamnée ou qui aurait été évincée à la suite d'une sanction disciplinaire en raison de son comportement, frappe à la porte d'à côté."

Geffray said the bill's objective "est vraiment de sécuriser l'intégralité de la sphère scolaire et périscolaire (…) pour qu'à partir du moment où quelqu'un met les pieds dans l'école, on puisse avoir la certitude absolue qu'il n'a jamais été ni condamné, ni sanctionné par l'administration en raison de son comportement."
